1. Acceptance of Terms

Welcome to TrailTimes. By accessing or using the TrailTimes application ("Service"), including our mobile applications for iOS and Android, our website, and any related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

TrailTimes ("we," "us," or "our") operates the TrailTimes mobile applications and website. These Terms govern your use of the Service across all platforms.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To access certain features of the Service, you must create an account. You may register using your email address or through third-party authentication providers (such as Google or Apple). You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You must notify us immediately of any unauthorized use of your account.

4. Use of the Service

TrailTimes provides tools for recording, tracking, and reviewing outdoor activities such as hiking and biking, including GPS-based activity recording, trail matching, leaderboards, social features, and route planning. You agree to use the Service only for lawful purposes and in accordance with these Terms.

You agree not to:

• Use the Service in any manner that could damage, disable, overburden, or impair the Service
• Attempt to gain unauthorized access to any part of the Service or its related systems
• Use the Service to harass, abuse, or harm other users
• Upload content that is unlawful, defamatory, obscene, or otherwise objectionable
• Reverse engineer, decompile, or disassemble any part of the Service
• Use automated means to access the Service without our express permission
• Manipulate leaderboard rankings, activity data, or trail completion records through fraudulent means

5. User Content

You may submit content through the Service, including activity recordings, photos, comments, ratings, and profile information ("User Content"). You retain ownership of your User Content, but by submitting it, you grant TrailTimes a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and providing the Service.

You represent and warrant that you have the right to submit any User Content and that your User Content does not violate any law or infringe on the rights of any third party. We reserve the right to remove any User Content that violates these Terms or that we find objectionable, at our sole discretion.

6. Location Data and GPS

The Service relies on GPS and location data to provide core functionality including activity recording, trail matching, and route navigation. By using these features, you consent to the collection and processing of your location data as described in our Privacy Policy.

GPS accuracy can vary depending on your device, environmental conditions (such as tree canopy, weather, and terrain), and other factors. TrailTimes does not guarantee the accuracy of GPS data, distance calculations, elevation measurements, or trail matching results. You should not rely solely on the Service for navigation or safety decisions.

7. Subscriptions and Payments

TrailTimes offers both free and paid subscription plans. Paid subscriptions are billed on a recurring basis (monthly or annually) through the platform on which you subscribed (Apple App Store, Google Play Store, or our website).

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your device's app store settings or your account settings on our website. Refunds are subject to the policies of the applicable app store or payment processor.

We reserve the right to change subscription prices with reasonable notice. Price changes will take effect at the start of your next billing period following the notice.

8. Safety and Assumption of Risk

Outdoor activities such as hiking and biking involve inherent risks including but not limited to injury, illness, property damage, and death. By using TrailTimes to plan or record outdoor activities, you acknowledge and assume all risks associated with such activities.

TrailTimes does not verify or guarantee the safety, condition, or legality of any trail, route, or outdoor area. Trail conditions can change due to weather, natural events, closures, or other factors. Always exercise your own judgment, check current conditions, follow local regulations, and carry appropriate safety equipment.

Leaderboard features and trail completion tracking are provided for informational and recreational purposes. Do not take unnecessary risks to improve your ranking or achieve trail completions.

9. Third-Party Services

The Service integrates with third-party services including authentication providers (Google, Apple), map data providers, cloud hosting services, and payment processors. Your use of these third-party services is subject to their respective terms and privacy policies. TrailTimes is not responsible for the practices or content of third-party services.

10. Intellectual Property

The Service, including its design, features, code, and content (excluding User Content), is owned by TrailTimes and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

Trail data, map data, and geographic information displayed in the Service may be sourced from third-party providers and is subject to their respective licenses, including OpenStreetMap data licensed under the Open Database License.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. TRAILTIMES DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

WITHOUT LIMITING THE FOREGOING, TRAILTIMES MAKES NO WARRANTY REGARDING THE ACCURACY OF GPS DATA, TRAIL INFORMATION, DISTANCE OR ELEVATION MEASUREMENTS, LEADERBOARD RANKINGS, OR ANY OTHER DATA PROVIDED THROUGH THE SERVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, TRAILTIMES AND ITS OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO TRAILTIMES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify, defend, and hold harmless TrailTimes and its officers, employees, agents, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, or your violation of these Terms.

14. Termination

We may suspend or terminate your account and access to the Service at any time, with or without cause, with or without notice. You may delete your account at any time through the Service's settings. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including ownership, warranty disclaimers, indemnification, and limitations of liability.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service and updating the "Last updated" date. Your continued use of the Service after such changes constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction.

17. General

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. These Terms constitute the entire agreement between you and TrailTimes regarding the Service.
